1. Introduction and Acceptance
- These Terms of Service ("Terms") govern your access to and use of PickMySeat, available at pickmyseat.in (the "Service"), operated by PickMySeat ("we", "us", "our").
- By creating an account, making a payment, or otherwise using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.
- If you are using the Service on behalf of a minor (see Section 3), acceptance by a parent or legal guardian is required.
2. Description of Service
- PickMySeat is a predictive analytics tool that estimates possible college and branch admission outcomes for the Tamil Nadu Engineering Admissions (TNEA) counselling process, based on historical allotment data (2022–2025) and machine learning models.
- Predictions are statistical estimates only. They are not a guarantee, promise, or assurance of admission to any college, branch, or category.
- PickMySeat is an independent, privately operated tool. It is not affiliated with, endorsed by, or connected to the Directorate of Technical Education (DoTE), Anna University, the Government of Tamil Nadu, or any official TNEA counselling authority.
- Always verify eligibility, cutoffs, seat availability, and counselling procedures against official TNEA sources before making admission decisions.
3. Eligibility and Use by Minors
- The Service is intended for use by students applying to TNEA counselling and their parents or guardians. We recognise that many users are under the age of 18.
- If you are under 18, you may only use the Service with the involvement and consent of a parent or legal guardian, who accepts these Terms on your behalf and takes responsibility for account activity, including any payment made.
- By registering an account for or with a minor, the registering adult confirms they are a parent, guardian, or otherwise authorised to provide such consent.
- We do not knowingly use a minor's personal data for behavioural monitoring, tracking, or targeted advertising. See our Privacy Policy, Section 6.
4. Account Registration and Security
- You must provide accurate, current, and complete information when registering, including academic marks and community category, and keep this information up to date.
- You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
- One account is permitted per user. We reserve the right to suspend or terminate duplicate or fraudulently created accounts without refund.
- Notify us immediately at support.pickmyseat@gmail.com if you suspect unauthorised access to your account.
5. Acceptable Use
- You agree not to use the Service for any unlawful purpose or in violation of any applicable Indian law.
- You must not scrape, reverse engineer, decompile, copy, or attempt to extract the underlying prediction models, datasets, or source code of the Service.
- You must not interfere with, overload, or attempt to gain unauthorised access to the Service's systems, servers, or data, including through automated bots or scripts.
- You must not submit false academic data, impersonate another person, or use another individual's rank or marks to access predictions.
- Violation of this Section may result in immediate suspension or termination of your account without refund.
6. Fees, Payments and Refunds
- Premium access ("Grade 1") is available for a one-time fee of ₹149 (inclusive of applicable taxes unless stated otherwise), processed securely through Razorpay.
- We do not collect or store your card, UPI, or bank account details; these are handled directly by Razorpay under its own terms and security standards.
- Payments are non-refundable once premium prediction access has been successfully granted and used, except where required by applicable Indian consumer protection law.
- A refund will be provided if: (a) payment was successfully deducted but premium access was not granted due to a technical fault on our end, or (b) the Service was materially unavailable or non-functional at the time of purchase and remained so despite a support request. Refund requests must be raised within 7 days of payment to support.pickmyseat@gmail.com with proof of payment.
- Duplicate payments caused by a technical error will be refunded in full upon verification.

7. Intermediary Status
- To the extent the Service allows any user-submitted content (including feedback, support queries, or reviews), PickMySeat is an "intermediary" as defined under Section 2(w) of the Information Technology Act, 2000, and is entitled to the safe-harbour protections available to intermediaries under Section 79 of that Act.
- We do not initiate the transmission of user content, do not select the receiver of any transmission, and do not modify user-submitted content, except as necessary for moderation consistent with applicable law.
8. Intellectual Property
- All software, machine learning models, algorithms, design, text, graphics, logos, and other content on the Service (excluding publicly sourced TNEA allotment data) are the property of PickMySeat or its licensors and are protected by applicable intellectual property laws.
- You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your personal, non-commercial use only.
- You may not reproduce, redistribute, resell, publicly display, or create derivative works from any part of the Service without our prior written consent.
- You must not use any automated means (bots, scrapers, crawlers, or similar tools) to extract predictions, cutoff data, or any other content from the Service in bulk, or to build a competing product or dataset. Violation of this clause entitles us to suspend your access immediately and pursue damages.
9. Disclaimers
- Predictions are generated using statistical models trained on historical TNEA allotment data (2022–2025) and are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including accuracy, completeness, reliability, or fitness for a particular purpose.
- Actual TNEA cutoffs, seat matrices, and admission outcomes may vary from year to year due to factors outside our control, including changes in reservation policy, seat availability, and applicant volume.
- The Service is provided on an "as is" and "as available" basis, on a best-efforts basis only. We give no guarantee of server uptime, response time, or continuous availability, and the Service may be unavailable at any time due to maintenance, technical failure, or circumstances beyond our control.
- Payments are processed via a third-party payment gateway (Razorpay) over networks not controlled by us. We are not responsible for any loss, delay, or disclosure of information arising from the payment gateway's processing, transmission, or verification of your payment instrument, except to the extent caused by our own gross negligence.
- You are solely responsible for the security of the device and payment instrument used to transact on the Service.
- You are solely responsible for verifying all information through official TNEA channels before making any admission-related decision.
10. Limitation of Liability
- To the maximum extent permitted by applicable law, PickMySeat, its founders, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of admission opportunity, loss of data, or loss of profit, arising from your use of, or inability to use, the Service.
- Our total aggregate liability arising out of or relating to these Terms or the Service shall not exceed the amount you actually paid to us in the six (6) months preceding the event giving rise to the claim, or ₹500, whichever is greater.
- Nothing in these Terms limits liability that cannot be excluded or limited under applicable Indian law, including liability for fraud or wilful misconduct.
11. Indemnification
- You agree to indemnify and hold harmless PickMySeat and its founders, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your breach of these Terms, misuse of the Service, or violation of any applicable law.
12. Privacy
- Our collection and use of your personal data, including academic marks and community category, is governed by our Privacy Policy, which forms part of these Terms.
13. Suspension and Termination
- We may suspend or terminate your access to the Service, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or misused the Service.
- You may stop using the Service and request account deletion at any time by contacting support.pickmyseat@gmail.com.
- Sections relating to Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law shall survive termination.
14. Grievance Officer
- In accordance with the Information Technology Act, 2000 and the rules made thereunder, the Grievance Officer for PickMySeat is:

The Grievance Officer will acknowledge complaints within 24 hours and endeavour to resolve them within 15 days of receipt.
15. Governing Law and Dispute Resolution
- These Terms are governed by the laws of India.
- Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved amicably through written notice to support.pickmyseat@gmail.com, with a response within 15 days.
- If not resolved amicably within 30 days, the dispute shall be referred to and finally resolved by arbitration before a sole arbitrator appointed mutually by the parties, in accordance with the Arbitration and Conciliation Act, 1996 (as amended). The seat and venue of arbitration shall be Chennai, Tamil Nadu, India, and the proceedings shall be conducted in English. The arbitrator's award shall be final and binding on both parties.
- Subject to the arbitration clause above, the courts at Chennai, Tamil Nadu, India shall have exclusive jurisdiction over any matter not subject to arbitration (e.g., interim relief).
16. Force Majeure
- We shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including server outages, internet infrastructure failures, government action, or force majeure events.
17. Severability and Entire Agreement
- If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.
- These Terms, together with the Privacy Policy, constitute the entire agreement between you and PickMySeat regarding the Service.
18. Changes to These Terms
- We may update these Terms from time to time. Material changes will be notified via a banner on the Service or by email at least 7 days before taking effect.
- Continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree, you must stop using the Service.
